TERMS & CONDITONS OF PHONE AND INTERNET SALES

AMEX USERS: American Express no longer refunds processing fees when we provide you with a refund on your purchase. Customers using American Express who require a refund, will receive their refund minus the AMEX transaction fees. Unfortunately we are not able to absorb these fees, or increase our pricing to absorb these costs.

I would like to take this opportunity to thank you for visiting BMC Tackle and to also thank you for doing business with me. My name is Louis, I own BMC Tackle Inc. it is my pleasure to assist you with your purchase and to answer any question you may have.

At BMC Tackle your 100% satisfaction is very important to me. If you purchase a product from me and you are not thrilled with it, I will be happy to:

  1. Refund your money (see exclusions below)
  2. Exchange it
  3. Give you a store credit in the form of gift certificates that can be used at anytime. My Gift Certificates NEVER EXPIRE!

All I ask is that your return the unused item in its original box and that you call or email me for the SPECIFIC ADDRESS that the item needs to be returned to, and for a return authorization number so I can credit the return to your specific purchase. The only costs that are not refundable are shipping expenses. Shipping expenses will be deducted from the final refund price, this is inclusive of items that are covered by our free shipping policy. Refusal of delivery on any item. or failure to follow our return shipping policy will require a 30% restocking fee. This return policy is good for seven days from the time the item arrives at your door. This allows you a full week to decide. There are some exclusions, please see below:

  1. Products that are defective upon arrival are excluded from our return policy, we will exchange these at no cost to you.
  2. Manufacturer’s Warranty: All the items we sell are brand new in the box with full manufacturer warrany. Should you have a problem with any item within that item’s warrany period, please call me and I will assist you with obtaining a warrany repair or exchange.
  3. Warranty on Kristal and Dolphin Electric Reels is through Masters of the Deep aka: Kristal USA and Dolphin Electric Reels. We are an authorized Kristal USA dealer as well as a Dolphin Electric Reel Dealer. All sales on Kristal Electric Reels/Masters of the Deep, and Dolphin Electric reels are final. Exchanges on defective merchandise and/or warranty repairs are handled through the manufacturers, we will assist the customer in the exchange process. Time frames and shipping requirements are subject to manufacturer time frames.
  4. Sceptre Fishing Rods: Sceptre Rods come standard with Silver wraps on a black blank. Please note that some of our rods are special order items. We can have these rods made with any color you wish. Calstar and Seeker blanks are available and both are custom orders. Our lead time on most rods is 2-3 weeks. During the holidays this may take longer, please verfify lead times prior to placing your order if you have a specific time frame to meet.
  5. Colors: In cases where colors are not specified, we will contact you prior to shipping the item.
  6. BMC Avet Drag Updates: At BMC we came up with this update for our customers who prefer to use lighter drag settings with their Avet LX, MX, JX, or SX reels. This update allows the angler more control of the drag setting, ideal for those who fish for kingfish, sailfish, stripers and other species. These updates are available exclusively through us. If you wish to have a reel updated I will be happy to do this for you. I require that the reels be sent in. This update is available at no charge when you purchase the reel from me. The BMC Drag Update does not affect the Avet Reel Warranty.
  7. Ebay Sales: At times we offer some products via Ebay, these are typically closeouts. The terms outlined above apply to all the items we sell, whether via Ebay or on the website.
  8. I am unable to issue a refund or exchange on any item that’s been used or not in it’s original container. All sales are final on Special Order Non-Inventory purchases. All electric reels and Black Pearl Castnets are special order non-inventory items, also see #15.
  9. Used Tackle: At BMC I do not purchase, nor do I sell used tackle of any type. At certain times a known customer may want to sell an item, or items. If a customer is known to me, I will make an exception to this rule. This is the only time that a used item is made available. These items will be put out to our customers via our newsletter, which when generated, is automatically sent out to all our customers who have purchased items from us in the past and opted to receive our newsletter. Refurbished Kristal Reels have a full warranty from Kristal Reels USA/Masters of the Deep, all sales are final on electric reels and factory refurbished products.
  10. Gift Certificates: All BMC Gift Certificates are good indefinitely. These never expire and we do keep a record of these purchases. If you have received a gift certificate and you lost it, don’t worry. Give me a call and I will take care of this right away and re-issue a copy if you need it, or apply the certificate to your current purchase.
  11. Free Shipping: Free Shipping is within the continental USA only. At times if the shipping costs to Hawaii, Puerto Rico, Alaska, FPO, & APO are the same, we will honor the free shipping policy to those areas. USPS Priority Mail rates apply. International shipping is not included in our free shipping policy. Items that feature free shipping will be labeled as such.
  12. US Military: At BMC we appreciate what our military is doing for us overseas. ALL military personnel are entitled to special discounts. Please email me and I will be happy to provide you with as much as I can. We value our military personnel and are honored to contribute in any way we can. We support & sponsor HookingUpHeroes.com A program developed here in South Florida to take our members of the armed forces fishing when they visit our ports. Our military is very much appreciated!
  13. Law Enforcement, Homeland Security, Paramedics, medical, and Fire Department personnel: At BMC we appreciate the outstanding jobs you do in our community, we appreciate the job you do in keeping us safe. We offer special discounts and offers to those of you who serve our communities in these capacities.
  14. Helium Systems: It is the customers responsibility to secure a filling station for helium systems prior to purchase. Due to size and weight issues all Helium System returns will incur a 30% restocking fee plus all shipping fees.
  15. Non-returnable items: Unless defective upon arrival, sales on the following items are final: AquaShox Mat, AquaGel Mat, Sea Angler Fish Bags, Home Port Charts, and Helium Balloons. If any of these items arrive defective, we will exchange them at no charge to the customer.
  16. BMC Shipping methods and time frames: At BMC I ship via FedEx, UPS, and USPS only. Some of our drop shippers utilize UPS. We ship most orders same day, depending on shipping volume, at times we will experience delays, particularly during the holidays. It is the customers responsiblity to ask for specialized deliveries when time frames are involved. We are not responsible for delivery delays once the shipment leaves our facility. In an effort to save our customers money on shipping charges, we drop ship items that are bulky and costly to ship to us then to you. By shipping it once we save on shipping costs and pass these savings on to you. Items that fall into this category are HydroGlow Lights, Sea Angler Fish Bags, Black Pearl Castnets, and Gameface Gear belts and harnesses. If you have any questions with regards to shipping times or need an item quickly, please call me before you place the order. Drop ship items will ship within 72 hours unless otherwise stated.   17. Credit Card Chargebacks: At BMC Tackle we have a very liberal return policy, making the need for a credit card chargeback totally unnecessary. A credit card chargeback where the item is kept and not returned, we consider as theft. We will place all frivolous credit card chargebacks on collections. Those who engage in this type of behavior will be responsible for collection costs, attorney fees, court costs, and 12% interest per month will be added. In addition criminal charges may also apply. Frivolous credit card charge backs increase consumer and business costs making retail prices higher for everyone, at BMC Tackle we take this very seriously and we will vigorously pursue all avenues of collections in these matters.
