TERMS & CONDITONS OF PHONE & INTERNET SALES
I
would like to take this opportunity to thank you for visiting BMC Tackle and to also thank you for doing business with
me. My name is Louis, I own BMC Tackle Inc. it
is my pleasure to assist you with your purchase and to answer any
question you may have.
I hate to use the term Terms and Conditions. At BMC Tackle Inc. your 100% satisfaction is very important to
me. If you purchase any product from me and you are not thrilled with
it, I will be happy to:
- Refund your money
- Exchange it
- Give you a store credit in the form of gift certificates that can be used at anytime. My Gift Certificates NEVER EXPIRE!
All I ask is that your return the unused item in its original box and
that you call me with a tracking number so I can insure the package
for its return back to me. The only costs that are not refundable
are shipping expenses. Shipping expenses will be deducted from the
final refund price, this is inclusive of items that are covered by
our free shipping policy. Refusal of delivery on any item. or failure to follow our return shipping policy, will require a 30% restocking fee. This return policy is good for seven
days from the time the item arrives at your door. This allows you
a full week to decide. There are some exclusions, please see
below.
- Products that are defective upon arrival at your door, are excluded
from our return policy, we will exchange these at no cost to you.
- Manufacturer’s Warranty: All the items we sell are brand
new in the box with full warrantys, this includes the Avet Reels
labeled as blems or refurbished. Should you have a problem with
any item within that item’s warrany period, please call
me and I will assist you with obtaining a warrany repair or exchange. All sales are final on refurbished and special order non-inventory items.
- Crowder Rods Lifetime Warranty: We honor all Crowder Rod warrantys,
whether you purchased the rod from us or not. I will be happy
to help you obtain a replacement or repair.
- Sceptre Fishing Rods: Sceptre Fishing Rods feature our Sceptre
Rods Limited Lifetime Warranty. All Sceptre Rods carry a full
lifetime warranty on labor and components. Please note that some
of our rods are special order items. Gold wraps are always available,
call us to place a special order. Our Calstar Series is a custom
made to order rod. Our lead time on most rods is 2 weeks. During
the holidays this may be longer, please verfify lead times prior
to placing your order if you have a specific time frame to meet.
- Colors: In cases where colors are not specified, we will contact
you prior to shipping the item.
- Avet Reel Warranty: We will assist you with any Avet Reel repair
you may need. This is inclusive of whether you purchased the reel
from us or not.
- BMC Avet Drag Updates: At BMC we came up with this update for
our customers who prefer to use lighter drag settings with their
Avet LX, MX, JX, or SX reels. This update allows the angler more
amplitude between drag settings, making it the ideal reel update
for those who fish kingfish, sailfish, and striper tournaments.
These updates are available exclusively through us. If you wish
to have a reel updated I will be happy to do this for you. I require
that the reels be sent in. This update is available at no charge
when you purchase the reel from me. The BMC Drag Update does not affect the Avet Reel Warranty.
- Ebay Sales: The terms outlined above apply to all the
items we sell, whether via Ebay or on the website.
- I am unable to issue a refund or exchange on any item that’s
been used or not in it’s original container. All sales on
BallyHood Lures are final, unless the item is damaged or the colors
are incorred. All Ballyhood Lures are custom made on a per order
basis. All sales are final on Special Order Non-Inventory purchases.
- Used Tackle: At BMC I do not purchase, nor do I sell used tackle
of any type. At certain times a known customer may want to sell
an item, or items. If a customer is known to me, I will make an
exception to this rule. This is the only time that a used
item is made available. These items will be put out to our customers
via a cyber circular, which when generated, is automatically sent
out to all our customers who have purchased items from us in the
past. All cyber circulars have an unsubscribe option if you wish
not to receive these. You may also call me and I will be happy
to take you off the list or add you if you happen not to be on
it. Refurbished Kristal Reels have a full warranty from Kristal Reels USA/Masters of the Deep, all sales are final on factory refurbished products.
- Gift Certificates: All BMC Gift Certificates are good
indefinitely. These never expire and we do keep a record of these
purchases. If you have received a gift certificate and you lost
it, don’t worry. Give me a call and I will take care of
this right away and re-issue a copy if you need it, or apply the
certificate to your current purchase.
- Free Shipping: Free Shipping is within the continental
USA only. At times if the shipping costs to Hawaii, Puerto Rico,
Alaska, FPO, & APO are the same, we will honor the free shipping
policy to those areas. USPS Priority Mail rates apply. International
shipping is not included in our free shipping policy. Items that
feature free shipping will be labeled as such. Some items such
as fishing rods and others which may have different accessories/options
included, will have shipping charges added when the item is shipped.
The customer may request total shipping charges prior to shipping
either via email, phone, or by requesting so in the comments section
of the order page.
- US Military: At BMC we appreciate what our military
is doing for us overseas. ALL military personnel are entitled
to special discounts. Please email me and I will be happy to provide
you with as much as I can. We value our military personnel and
are honored to contribute in any way we can. We support &
sponsor HookingUpHeroes.com A program developed here in South
Florida to take our members of the armed forces fishing when they
visit our ports. Our military is very much appreciated!
- Law Enforcement, Homeland Security, Paramedics, medical,
and Fire Department personnel: At BMC we appreciate the
outstanding jobs you do in our community, we appreciate the job
you do in keeping us safe. We offer special discounts and offers
to those of you who serve our communities in these capacities.
- Due to size and weight issues all Helium and Oxygen System returns
will incur a 30% restocking fee plus all shipping fees.
- BMC Shipping methods and time frames: At BMC I ship via FedEx,
USPS, and at times UPS. We ship most
orders same day, depending on shipping volume, at times we will
experience delays, particularly during the holidays. It
is the customers responsiblity to ask for specialized deliveries
when time frames are involved. We are not responsible for delivery
delays once the shipment leaves our facility. In an effort
to save our customers money on shipping charges, we drop ship
items that are bulky and costly to ship to us then to you. By
shipping it once we save on shipping costs and pass these savings
on to you. Items that fall into this category are HydroGlow Lights,
Sea Angler Fish Bags, Black Pearl Castnets, and Gameface Gear
belts and harnesses. If you have any questions with regards to
shipping times or need an item quickly, please call me before
you place the order. Drop ship items will ship within 72 hours
unless otherwise stated. (954) 317-3532 HydroGlow Dockmaster Lights
are made to order, please allow 2-3 week delilvery times from
the time the order was placed.
- Credit Card Chargebacks: At BMC Tackle Inc. we have a very liberal return policy, making the need for a credit card chargeback not necessary. A credit card chargeback where the item is kept and not returned, we consider as theft. We will place all frivolous credit card chargebacks on collections. Those who engage in this type of behavior will be responsible for collection costs, attorney fees, court costs, and 12% interest per month will be added. In addition criminal charges may also apply. Frivolous credit card charge backs increase consumer and business costs making retail prices higher for everyone, at BMC Tackle we take this very seriously and we will vigorously pursue all avenues of collections in these matters.
